Employers that have 100 or more employees, and federal contractors & subcontractors that have 50 or more employees & at least $50,000 of federal business, are required to file an EEO-1 report each year with the Equal Employment Opportunity Commission (EEOC). The Obama administration issued rules requiring these employers to report, not only on the race/ethnicity & sex of their workforces (Component 1 Data), but also report how much employees were paid by race/ethnicity & sex. The Trump administration suspended this pay reporting rule from taking effect in 2017. The U.S. District Court for the District of Columbia subsequently ordered the EEOC to collect detailed data on employee compensation and hours worked from covered employers sorted by job category, pay band, race, ethnicity, and sex (Component 2 Data). The court ordered the EEOC to collect this data for calendar years 2017 and 2018. The Court has now issued and order declaring the EEOC’s collection of EEO-1 report pay data (Component 2) for calendar years 2017 and 2018 "complete." The EEOC has accordingly updated its website to advise that "the EEO-1 Component 2 ‘pay data’ collection for 2017 and 2018 is now complete." For employers that are currently in the process of submitting data and would like the opportunity to file, the Component 2 portal will remain open until 5:00 pm EST on February 14, 2020.
