After the Wage and Hour Division found that Bank of America failed to provide reasonable break time and a space free from intrusion for a nursing mother to express breast milk at a Tucson, Arizona, location, the Department of Labor has signed off on an agreement under which the Bank will implement systemic changes. Under federal law (Section 7 of the Fair Labor Standards Act), employers must provide reasonable break time for an employee to express breast milk for her nursing child for one year after the child’s birth each time the employee needs to express the milk. Employers are also required to provide a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public, which may be used by an employee to express breast milk.
